1. Booking Confirmation

 

A booking is considered confirmed once the required deposit or full payment has been received and written confirmation has been issued byOman Explorers.The written booking confirmation will identify the agreed itinerary, travel dates, services included, total price, payment schedule, and anybooking-specific cancellation or amendment conditions.By confirming a booking, the client acknowledges that they have read, understood, and accepted these Terms & Conditions.

 

2. Payment Terms

 

A deposit, typically ranging from 30% to 100% of the total tour price depending on the tour and arrangements involved, is required to secure abooking. The applicable deposit amount and payment deadlines will be specified in the quotation or booking confirmation.

 

The remaining balance must be paid by the agreed deadline and, unless otherwise confirmed in writing, before the start of the tour. Bookingsmade close to the departure date may require full payment at the time of booking.

 

The deposit is subject to the cancellation terms specified in Section 5 and is not automatically forfeited in full in every cancellation scenario.The applicable cancellation charge will be calculated according to the agreed cancellation schedule and any expressly agreed bookingspecificconditions.

 

Failure to pay the balance by the agreed deadline may result in cancellation of the booking, subject to the applicable cancellation provisions.All payments must be made to the contracting entity or through an authorized payment method specified by Oman Explorers.

3. Prices and Services

 

All prices are quoted in Omani Rials (OMR), unless otherwise stated, and cover only the services expressly listed in the accepted quotation orconfirmed itinerary.

For an accepted quotation, the total price will be fixed once the dates, itinerary, accommodation, inclusions, and other relevant arrangementshave been confirmed in writing.

 

Following confirmation, the price may be adjusted only where applicable under the booking agreement, including:

 

• Changes requested by the client that affect the itinerary, accommodation, participant numbers, transport, or other services.

• Additional services requested or approved by the client.

• New or increased government taxes, statutory charges, or mandatory fees imposed after confirmation.

• Material supplier price changes or operational circumstances that could not reasonably be anticipated at the time of confirmation, wherethe booking agreement expressly permits such adjustments.

 

Oman Explorers will notify the client in writing of any proposed adjustment, explain the reason and amount, and obtain the client's writtenagreement before applying an additional charge. If the parties cannot agree on a proposed adjustment, the Company will discuss the availablealternatives and any applicable cancellation or refund rights under the booking agreement and applicable law.No undisclosed additional charge will be applied without the client's written agreement.

 

4. Changes and Amendments by the Client

 

Requests to amend a confirmed booking, including changes to dates, itinerary, accommodation, participant numbers, or other services, aresubject to availability and supplier approval.

Oman Explorers will communicate any applicable amendment fee or additional supplier charge before the client confirms the change.Where an amendment can be accommodated without cancelling the original booking, the existing booking will remain in place, subject to theagreed changes and any additional costs accepted in writing.

A date change will not automatically be treated as a cancellation. If a requested change cannot be accommodated and cancellation orrebooking becomes necessary, the applicable consequences will be explained to the client before proceeding.

Any supplier penalties resulting from an approved amendment will be disclosed in writing and supported by the relevant supplier information.

5. Cancellation by the Client

All cancellations must be submitted in writing to Oman Explorers. The cancellation date will be determined by the date the written
cancellation notice is received.
Unless different terms have been expressly agreed in writing for a particular booking, the following cancellation schedule applies:

• More than 1 month before arrival or tour commencement: No cancellation fee applies. The full deposit paid is refundable.

• More than 14 days before arrival or tour commencement: 25% of the deposit paid is retained as the cancellation charge. The remaining

• 75% of the deposit is refundable.

• 7–14 days before arrival or tour commencement: 50% of the deposit paid is retained as the cancellation charge. The remaining 50% of

• the deposit is refundable.

• Less than 7 days before arrival or tour commencement: 100% of the deposit paid is retained as the cancellation charge.

• No-show or failure to arrive: 100% of the deposit paid is retained as the cancellation charge.

 

For clarity, the percentages above are calculated against the deposit actually paid, not the total tour price.
The balance of any refund, where applicable, will be processed using the agreed payment method, subject to applicable payment-provider processing conditions and any legally permissible deductions disclosed to the client.

Refunds are processed according to the payment method used.
1.For payments made by bank transfer, the applicable refund amount will be refunded in full in accordance with the above policy.
2.For payments made through the online payment link gateway, a transactional processing fee of 4.4% will be deducted from the applicable refund amount, as these are charges are non-refundable and are retained by the payment service provider.

Third-party supplier charges

Certain bookings may involve advance commitments to hotels, camps, transport providers, activity operators, or other third-party suppliers.
Any supplier-specific cancellation penalties that differ from the standard schedule must be identified in the booking-specific terms or separately disclosed and accepted by the client in writing before the booking is confirmed.

Where such penalties apply, Oman Explorers will provide a written breakdown identifying the relevant supplier, the applicable cancellation policy, and the amount charged or retained.

Supplier penalties will not automatically be added on top of the cancellation charges listed above. Any additional liability beyond the stated cancellation schedule must have been expressly disclosed and agreed in writing for the particular booking, subject to applicable law.
If no different supplier-specific cancellation conditions have been disclosed and agreed in writing, the standard cancellation schedule above will apply.

6. Cancellation or Changes by Oman Explorers

Oman Explorers reserves the right to cancel, postpone, or modify a tour where reasonably necessary due to safety concerns, adverse weather, access restrictions, supplier unavailability, operational circumstances, or other events affecting the safe or practical delivery of the tour.

Where a change or cancellation is initiated by Oman Explorers, the Company will inform the client as soon as reasonably practicable and explain the available options.

Depending on the circumstances, these may include:

• An alternative tour or itinerary.

• Rescheduling to another available date.

• A refund of the amount paid for services that cannot be provided, in accordance with the booking agreement and applicable law.

• Any refund or alternative arrangement will be confirmed in writing. Client cancellations and operator-initiated cancellations will be treated separately under the applicable provisions.

 

7. Safety and Participation

Adventure activities, including canyoning, hiking, swimming, climbing, caving, and abseiling, involve inherent risks. Participants must assess
their suitability for the activity, disclose relevant health or physical limitations, and comply with the safety requirements communicated before and during the tour.
All participants must follow the instructions of their guides and comply with safety briefings, equipment requirements, and applicable local regulations.

Oman Explorers reserves the right to refuse participation or remove a participant from an activity where reasonably necessary to protect the participant, other guests, guides, or staff, including where a participant's conduct or condition creates a safety risk.
Where participation is refused or discontinued for safety or conduct reasons attributable to the participant, any refund will be determined by the applicable booking terms and circumstances, subject to applicable law.

8. Travel Insurance
 

Participants are strongly advised to obtain comprehensive travel insurance appropriate to their itinerary and activities. Coverage should include medical expenses, emergency evacuation, accidents, trip cancellation or interruption, and personal belongings where relevant. Oman Explorers maintains tour operator liability insurance for adventure tourism, subject to the terms, conditions, exclusions, and limits of its insurance policy.

The Company's insurance does not replace personal travel insurance and should not be interpreted as a guarantee that every injury, expense, loss, or emergency-related cost will be covered.

9. Liability
 

Oman Explorers organizes tours and activities and may engage independent third-party providers, including accommodation operators, transport companies, activity providers, and equipment suppliers.
The Company will exercise reasonable care in selecting and coordinating services. Liability for the acts or omissions of third-party providers will be determined in accordance with the applicable contract and law.

Oman Explorers will not be responsible for loss, damage, injury, delay, or inconvenience to the extent caused by circumstances beyond its reasonable control, subject to applicable law.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

10. Force Majeure
 

Oman Explorers will not be held responsible for a failure or delay in performing its obligations to the extent caused by circumstances beyond its reasonable control. These may include, but are not limited to:

• Natural disasters or extreme weather.

• War, terrorism, civil unrest, or security threats.

• Government restrictions, permit restrictions, or border closures.

• Epidemics or pandemics.

• Strikes or significant transportation disruptions.

• Other unforeseen events that prevent or materially affect the safe delivery of the tour.

 

In such circumstances, Oman Explorers may modify, postpone, or cancel the affected services and will make reasonable efforts to arrange suitable alternatives where practicable.
Any resulting refund, credit, rescheduling arrangement, or unavoidable third-party cost will be handled in accordance with the bookingspecific terms and applicable law. Force majeure does not automatically entitle the Company to retain all payments in every circumstance.

11. Complaints and Feedback
Participants should report any concern to their guide or tour representative as soon as reasonably possible during the tour, allowing the Company an opportunity to investigate and address the issue where practicable.
If the matter cannot be resolved during the tour, the client should submit a written complaint to Oman Explorers with relevant details and supporting information.
Complaints submitted after completion will be reviewed, although delayed reporting may limit the Company's ability to investigate certain matters.

12. Governing Law
These Terms & Conditions are governed by the laws of the Sultanate of Oman. Any dispute arising from a booking will be handled by the competent authorities or courts of Oman, as applicable under the relevant law.

13. Contracting Entity and Acceptance of Terms
 

The contracting entity is The Peak Explorers LLC, operating as Oman Explorers. Quotations, confirmations and payment instructions must identify the contracting entity or authorized payment recipient; discrepancies must be clarified before payment. By confirming or paying, the
client accepts these terms and any additional conditions agreed in writing. An expressly agreed booking-specific provision takes precedence over a general provision to the extent of the variation, subject to applicable law.​​​​
